PRIVACY POLICY of The ProworkPL Website

ProworkPL, the owner of the www.prowork.pl website, makes every effort possible in order to protect your privacy. This privacy policy will notify you on how we protect your personal information and your rights.

I. Terms We Use in The Privacy Policy

ProworkPL, Us, Our  – Anna Kaczorowska conducting business as ProworkPL Anna Kaczorowska,  TAX identification number 798 116 35 66, with the company’s seat in Warsaw at 8 Warecka St. apt. 46.

Account – A set of resources and settings created for the User as part of the Website used to manage the services.

CV Profile – The account’s functionality that allows the User to collect information, such as the history of employment and education of the Employer – Employers or Human Resources consulting agencies for which Prowork PL conducts recruitment processes.

The Terms and Conditions – Terms and Conditions of electronic services on the www.prowork.pl website.

Recruitment Process With a Disclosed Employer– Recruitment for an Employer whose identity is known in the job offer and during the recruitment process.

Recruitment Process With an Undisclosed Employer – Recruitment for an Employer whose identity is kept hidden, both in the job offer and during the recruitment process. 

RODO (GDPR: General Data Protection Regulation) – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

Website – Internet website belonging to ProworkPL registered as www.prowork.pl

Privacy Settings – The account’s functionality which allows the User who uses the Services, to employ independent management and choice of preferences regarding the protection of his privacy.

User – Hereinafter referred to as the User, You, Yours, Candidate– legally adult natural person, who has an Account and uses the services offered by ProworkPL.

Regular User – Every person who uses the Website’s services that does not require a login.

II. Who is your personal data controller and how to contact them

Anna Kaczorowska conducting business as ProworkPL, TAX identification number 798 116 35 66, with the company’s seat in Warsaw at 8 Warecka St. apt. 46 is your personal information controller for the information that is processed in connection with using the Website and the participation in the recruitment processes. III. General rules applied to the processing of your personal data

1. We collect and process your personal information in order to fulfill the Contract between the Service Provider and the User, pursuant to Article 6 paragraph 1 point (b) of the GDPR.

2. We collect personal information directly from the Candidate, that is from the person they concern.

3.The Candidate provides personal information voluntarily, however not providing some of the information does not allow for the performance of the contract.

4. At the moment of transferring your personal information to the Employer during the recruitment process, that Employer becomes the Controller of your personal data and is entrusted with the obligations imposed on him pursuant to the GDPR.

5. Personal data is processed in a non-automated manner. Profiling is not done.

6.Personal data is made available to recipients indicated in Part V below.

IV. Types of personal Data we process, why we process this Data and our legal basis for processing this personal Data

Below we describe the rules and the possible scope of processing your data. We only provide information on potential uses of your personal data. In each case, you will receive additional clear information about the purpose of processing your data and when required, we will ask for your explicit consent, which you can withdrawal at any time. The processing of your data in ProworkPL takes place in accordance with applicable law, including the GDPR.

Below is the information regarding the processing of your data described according to the purpose for which your personal data will be used.

1. When you use the CV Profile Account

We process the personal data provided by you in the Registration Form and CV Profile Account, i.e. : name, surname, date of birth, e-mail address, telephone number, selected industry, profession, country of work, city, foreign language proficiency, other data provided in the CV Profile and data about your activity on the Website, i.e. the history of applying for job offers and the history of logging in and the IP address.

The purpose is to provide services requiring the set-up of an account; including application for offers, sharing a profile, access to application status and its history and access to Privacy Settings.

Providing the data expressly marked as obligatory is a condition for using the Account’s service and functionality. In the absence of your consent to provide this data, we cannot provide certain Account services and functionalities. In addition to information marked as mandatory, providing other personal information is voluntary.

Legal basis: Necessity to comply with the contract for the provision of services in accordance with the Rules and Regulations (Article 6, paragraph 1, point (b)) of the GDPR.

2. When we share your Profile with Perspective Employers

Sharing your personal data (from the CV Profile) with Employers may take place when:

·       You apply for a job offer posted on the Website and thus start participating in a given recruitment process. If you meet the Employer’s expectations, we provide the Employer with your profile.

·       We recommend your Candidate Profile to Employers.

If you have an active CV Profile Account, ProworkPL can pre-present an Employer with your Profile (ProworkPL recommendation) and offer you participation in a given recruitment process.

Legal basis: The User’s Consent (Article 6, paragraph 1, point (a) of the GDPR).

Such consent includes the Sharing of the User’s Profile with Employers as a result of:

·       Applying for the offer by the Candidate

·       Profile recommendation by ProworkPL.

While conducting a Recruitment Process with an undisclosed employer, ProworkPL  notifies you of the intention to submit your personal information to the Employer. In the absence of objections, the data is passed on to the Employer for further recruitment and for setting the date and manner in which the interview will be held.

3. When You Use The Newsletter Service

Subscription of job offers and news concerning ProworkPL services, requires the providing of: name and e-mail address for registration and subscription management.

Providing this information is voluntary but necessary to activate the service.

Legal basis: The legitimate interest relating to the marketing of our services.

4.When You Use Services That Do Not Require Creating an Account

We process your personal data to provide services that do not require the creation of an Account, i.e: searching for job offers on the Website and informative content that uses cookies and Google Analytics.

The purpose of this is for statistical data and proper functionality of the Website.

Legal basis: our properly explained and legitimate objective (Article 6, paragraph 1, point (f) of the GDPR) for the purpose of maintaining the functionality of the website.

5. In Order To Make The Website More Accessible, Statistics and IT security of the Website

For these purposes, we process personal data associated with your activity on the Website, such as: pages and subpages of the website, as well as data about your search history, your IP address and location.

Legal basis: our properly explained and legitimate objective (Article 6, paragraph 1, point (f) of the GDPR) that translates into facilitating the use of services provided electronically and improving the functionality of these services.

6. In order To Investigate and Enforce Claims as well as Resolve Complaints and Motions

For this purpose, we may process certain personal data provided by you in the CV Profile, such as: name, surname, date of birth, history of login and use of services, IP and other data necessary to prove the existence of the claim, including the extent of the damage suffered.

Legal basis: Our legitimate interest (Article 6, paragraph 1, point (f) of the GDPR), consisting of the determination, investigation and enforcement of claims and defense against claims in proceedings before courts and other state authorities.

V. Who do we share your personal information with?

Your data can be shared with the following categories of recipients:

1. Employers

We provide your personal data to Employers commissioning us to recruit. Your personal data is made available when you share your profile in the recruitment process.

Employers with whom we share your personal data independently determine the purposes and methods of processing this data (the Controller), they are not subject to our orders in this respect and when they receive your data- become their Controller.

Therefore, we are not responsible for their actions and negligence.

Location: Our Employers are based in Poland and in the countries of the European Economic Area (EEA) and in Switzerland.

In the case of transferring your data outside the EEA, our Employers guarantee a high level of protection of personal data, resulting in particular from the obligation to use standard contractual clauses adopted by the Commission (EU).

2. Service Providers

We provide your personal data to service providers of services required to run the Website.

Processing entities. We use service providers who process your personal data only at our request regarding the purposes and methods of processing your data (processing items) and provide among others, hosting, e-mail services and traffic analysis on the Website.

Location. Our service providers are based in Poland but some are based outside the EEA. Should your data be transferred outside of the EEA, our service providers guarantee a high level of personal data protection, resulting in particular from the obligation to use standard contractual clauses adopted by the Commission (EU) or participation in the Privacy Shield program established by the Commission Implementing Decision (EU ) 2016/1250 dated July 12th 2016 on the adequacy of protection provided by the EU-US Privacy Shield. You have the right to demand copies from us of the standard contractual clauses by addressing the request as outlined in section 2 of the Privacy Policy.

3. State authorities

We share your personal data if we are approached by State Authorities, particularly the organizational units of the Prosecutor’s Office, the Police, the President of the Office for Personal Data Protection, the President of the Office of Competition and Consumer Protection or the President of the Office of Electronic Communications.

IV. How long we store your personal data

1. CV Profile account

 We store your personal data for the duration of your Account ownership on the Website for the purpose of providing the Account services and related functionalities in accordance with the Rules and Regulations.

After deleting your Account, your personal details will be anonymized, except for the following: first name, surname, e-mail address, application history and information about consents (we will keep this data for a period of 2 years after the Account deletion for statistical purposes and until the expiry of the limitation period for  claims arising from the Agreement).

2. Newsletter Service

We store your personal data retained with the Newsletter service during the subscription period of the newsletter. After cancelling your subscription, your data is removed from the list of subscribers to the Newsletter.

3. Services without registration

We store personal data of regular Users (Users who are not logged in) only for the duration of time that the cookies are stored on their devices.

VII. What are your rights associated with the processing of your personal data

You can exercise your rights by submitting a request by sending an e-mail to: dane@powork.pl. In addition, after logging on to the Website, you can change your Privacy Settings on your CV Profile Account yourself.

1. The right to withdraw consent

You have the right to withdraw every consent granted at the time of registration on the Website and while using the services and the functionality of the Website. Withdrawal of consent is effective from the moment of the withdrawal. Withdrawal of consent does not affect the data processing carried out by us in accordance with the law before the withdrawal.

Withdrawal of consent does not imply any negative consequences for you. However, it may prevent you from continuing to use the Services and functionalities that we can provide legally only after you give consent (e.g. Sharing your Profile).

2. The Right to Object to The Processing of Data

You have the right to object to the processing of your personal data at any time if we process your data based on our legitimate interest.

3. The Right to Erasure (“The Right to Be Forgotten”)

You have the right to request the erasure of all or some of your personal data. A request to erase all personal data will be considered as a request to delete the Account.

Despite the request to delete personal data, in connection with opposition or withdrawal of consent, we may retain some personal data, such as: first name, surname, e-mail address and job application history as necessary for accounting purposes, investigation or defense of claims or handling complaints associated with the use of our services.

4. The Right to Restriction of Processing

You have the right to request a restriction of the processing of your personal data.

5. The Right to Access Data

You have the right to obtain confirmation from us whether we process your personal data, and if this is the case, you have the right to:

a) gain access to your personal data;

b) obtain information about the purposes of processing, categories of personal data being processed, recipients or categories of recipients of such data;

c) obtain a copy of your personal data.

6. The right to rectify data

You have the right to rectify and update your personal data. You can do this yourself after logging onto the CV Profile Account / Privacy Settings.

7. The Right to Transfer Data

You have the right to receive your personal information that you provided to us, and then send it to another personal data controller or request it to be sent directly to another controller, as much as it is technically possible.

8. The time frame of fulfilling your requests

We will process your request up to one month after receiving it, or if necessary, within the next two months and inform you of the intended extension.

9. Filing complaints, inquiries and motions

You can file complaints, inquiries and motions with us regarding the processing of your personal data and the exercise of your rights. If you believe that your right to personal data protection or other rights granted to you under the GDPR have been violated, you have the right to file a complaint with the President of the Office for the Protection of Personal Data.

VIII. Security of your data

ProworkPL makes every effort to ensure the security of your personal data. The website uses encrypted data transmission (SSL) during registration and logging in, which protects the data identifying you and makes it difficult to intercept access to your account by unauthorized systems or persons.

IX. How we use cookies

Cookies are text files saved by a web browser on the disc of your computer or other device for the purpose of storing information used for your identification or „remembering” the history of your activities on the Website.

We use cookies for the following purposes:

a. Providing services requested by you (necessary cookies)

We use our own cookies to enable you to log in to your Account, access the Website services for logged in Users and to allow smooth navigation on the Website’s pages without having to repeat the authentication process every time.

b. Optimizing the use of the Services (necessary and analytical cookies)

We use our own cookies to provide you with convenient use of the Website, including limiting the number of notifications appearing. We also use cookies to check the security of the information system and to „remember” your preferences.

c. Page and subpage Website statistics (analytical cookies)

We use third-party cookies (Google Analytics) to count visits to the Website, their duration and to determine which functionalities of the Website were most frequently used or visited. The information collected in this way allows us to analyze the effectiveness of the Website and ensure its development.

The terms of storage and access to cookies are defined in your browser settings, you can, among other things, reject saving new cookies, delete saved cookies, request notifications about saving a new cookie file and block the operation of cookies.

At the same time, we would like to inform you, that changes to cookie settings, by refusing to save cookies, may make it difficult or even impossible for you to use certain Website Services.

X. Changes to the Privacy Policy

ProworkPL can change and update the Privacy Policy. We will inform you about changes by posting information on the Website, and in the event of significant changes, we can send you notifications to the e-mail address provided by you.

The Privacy Policy does not limit any of your rights based on the Terms & Conditions  and the law.

The Rules and Regulations are effective as of May 25th 2018.
